TERMS AND CONDITIONS

1. SCOPE OF AGREEMENT
Please read our Terms and Conditions (the “Terms”) carefully before using www.sunformstudios.com (the “Site”) operated by SUNFORM LLC (“Sunform”, “us”, “we”, or “our”) and before booking classes. By booking a class or purchasing a package, at the end of this document you are confirming that you have read the Terms and agree to be bound by them. These Terms together with the items listed below, constitute a contract of membership between you (the client) and us (Sunform). Please ensure that you read and understand our Policy below carefully before attending any class at the studio.
2. STUDIO POLICIES, GUIDELINES, AND REQUIREMENTS
HEALTH & SAFETY:
By participating in Sunform classes, you acknowledge and accept the inherent risks associated with physical exercise. It is advisable to consult with a healthcare provider before beginning any new fitness regimen. Sunform and its instructors shall not be held liable for any injury or health condition that may result from your participation. If you have not had a recent medical check-up, you voluntarily participate at your own risk, fully accepting all responsibilities.
You are aware that engaging in physical activities or fitness programs involves inherent risks of injury. You understand that some classes may be conducted in elevated temperatures, potentially exceeding 100 degrees Fahrenheit. You accept and assume all risks of injury due to your actions or those of others.
This release shall unequivocally release Sunform, its affiliates, officers, members, directors, agents, employees, instructors, volunteers, independent contractors, and those acting on behalf of Sunform from all claims, injuries, and damages, present or future, anticipated or unanticipated, resulting from or arising out of your use or intended use of the facilities or equipment.
You affirm that you are at least 18 years old and have read and understood this release of liability. (A Parent or Guardian signature is required for participants aged 16-17.)
INJURY/PREGNANCY/POSTPARTUM/SENSITIVITIES:
If recovering from injury or illness, are recently postpartum, or have known physical or sensory sensitivities, please notify the instructor prior to class start time.
Heated classes are not recommended during pregnancy due to potential increases in core temperature from infrared heat. We offer non-heated classes and private, non-heated 1:1 sessions as safer alternatives, please contact with interest.
3. CLASS BOOKINGS, CANCELLATIONS, AND PAYMENTS
BOOKINGS:
We accept the following forms of payment: Visa, Mastercard, American Express. Cash payments are never accepted.
You agree to provide accurate, complete, and current account and payment information for all purchases and to update this information as needed, including email, payment method, and card expiration date. Sales tax will be applied as required, and prices are subject to change at any time. All payments are in USD.
You authorize us to charge your selected payment method for all purchases, including any applicable shipping fees, at the current prices. We reserve the right to correct pricing errors, even after payment is received.
We may refuse or limit any order at our discretion, including limiting quantities per person, household, or order. Orders that appear to be placed by dealers, resellers, or distributors may be restricted or prohibited.
CLASS RESERVATIONS AND CANCELLATIONS:
- CLASS RESERVATIONS: Class reservations must be made through our website. Each booking is subject to availability.
- CLASS EXPIRATION: Class packages have expiration dates, which are clearly stated at the time of purchase. Expiration extensions are available upon request for extenuating circumstances.
- CANCELLATIONS: If you need to cancel, please do so at least 12 hours before the scheduled class to avoid fees. Late cancellations may incur a fee or forfeiture of the class credit. The late cancel fee is $20, and the no-show fee is $40.
- REFUND POLICY: Sunform does not offer refunds on purchased class packages, memberships, or other services. Exceptions may apply under specific circumstances like emergencies, as determined at our discretion.
RETURNS AND REFUNDS:
All sales for Services (Class Packs, Drop-Ins, Events, and Workshops) are final and non-refundable, non-transferable, non-adjustable, and non-applicable to future purchases. Missed classes or any unused services are not eligible for a refund. Our schedule and offerings may change at any time, and this does not constitute grounds for a refund. We encourage you to be modest in your initial purchases, and make sure you can reach the venue and enjoy our services and our instructors before making a larger class pack purchases.
Workshops and events are non-refundable from the time of booking.
Gift card purchases are non-expiring but become non-refundable once applied.
- NON-RECORDING OF CLASSES AGREEMENT:
You acknowledge and agree that any type of recording or transmission (video, audio, still photography, streaming, social media posting, etc.) of any Sunform classes or activities is strictly prohibited without the prior written consent of an authorized corporate officer of Sunform. Sunform instructors are not authorized to provide consent.
You are, however, permitted to record and post lawful, non-offensive content related to your participation in a Sunform class before and/or after a class with the consent of each participant who is identified in your content.
Any violation of this non-recording agreement is grounds for exclusion from participation in any Sunform activities. You further agree to indemnify, defend, and hold harmless Sunform its officers, directors, employees, agents, and instructors, from and against any claims, lawsuits or other actions, and all resulting loss, damage or cost of any kind (including reasonable attorneys’ fees), resulting from your violation of this non-recording agreement.
- PERSONAL BELONGINGS:
You agree that we are in no way responsible for the safekeeping of your personal belongings while you are present in the studio. You assume all risk of loss for any of your personal belongings.
4. NON-HARASSMENT POLICY
We are committed to creating a welcoming environment for all members. You agree to conduct yourself respectfully with instructors, staff, and other participants. Any abusive, disruptive, or inappropriate behavior may result in suspension or termination of membership without refund.
Sunform does not condone any form of unwelcome, inappropriate, or offensive behavior by either staff or clients. If you feel you have experienced inappropriate conduct from Sunform personnel or during any Sunform-related event or class, we encourage you to inform the person involved directly, if you are comfortable doing so. When reporting an incident, please include as much specific information as possible, such as the date, time, location, names of any witnesses, details of the incident, and any surrounding circumstances.
Sunform will conduct a fair investigation and provide due process for all parties involved. Our response will vary based on the specifics of each situation. We strive to maintain confidentiality throughout the investigative process; however, in some cases, disclosure of certain details may be necessary, and confidentiality cannot be fully guaranteed.
5. INTELLECTUAL PROPERTY RIGHTS
The content on Sunform website and apps, including but not limited to text, software, graphics, photos, sounds, videos, and interactive features (“Content”), as well as trademarks, service marks, and logos (“Marks”), are owned by or licensed to Sunform. All Content and Marks are protected by copyright and other intellectual property rights under applicable laws.
Content provided on the website is intended for informational and personal use only. Downloading, copying, reproducing, distributing, transmitting, broadcasting, displaying, selling, licensing, or exploiting any Content without the prior written permission of Sunform or the respective owners is strictly prohibited.
Sunform trademarks, logos, and other marks may not be used in any way that could cause confusion, nor may they be copied, imitated, or used, in whole or in part, without express prior written consent.
6. LIMITATION OF LIABILITY
Sunform is not liable for any direct, indirect, incidental, or consequential damages arising from the use or inability to use our Services. We make no guarantees regarding the availability, accuracy, or reliability of our Services.
7. PRIVACY
Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information.
8. CHANGES TO THESE TERMS
Sunform reserves the right to modify these Terms at any time at its sole discretion. If significant changes are made to these Terms, we will notify you through means such as email, a posted notice on our website, or other methods. Your continued use of our Services after receiving such notification indicates your acceptance of the modified Terms.
If you disagree with any of these Terms or any changes, please do not use, access or continue to access the Services, or discontinue any use of the Services immediately.
